Return policies from Brokealty
If you are not satisfied with the Services of Brokealty subject to a Fee for a service or subscription commitment period and which is your initial purchase of such service, you may give us notice of cancellation for any reason within fourteen (14) days of the date you first ordered or activated such Brokealty Services (the “Refund” and the “Refund Period”). The Refund is only applicable to the initial purchase of Brokealty Services and any of its digital products. The Refund is not applicable to additional purchases, upgrades, modifications, or renewals of the Brokealty Services. If you reside in a jurisdiction that requires a longer Refund Period, we will of course be happy to accommodate such requirements, in accordance with all applicable laws. If Brokealty receives such notice within the Refund Period, it will refund you the amount actually charged you for the Brokealty Services, in the currency in which you were originally charged, and cancel them accordingly. Please note that the refund amount may differ from the amount charged to you due to exchange rate fluctuations and third-party fees. Brokealty will not be responsible for any differences caused by exchange rate fluctuations or fees charged by third parties. After the refund period, the fees paid by you are non-refundable and non-cancellable. Furthermore, if we find that a cancellation notice was given in bad faith or in an illegitimate attempt to avoid payment for services actually received and enjoyed, we reserve the right to continue charging the User who submitted such notice for the Brokealty Services actually received, to the extent permitted by law.
Please note: Some services purchased on or through Brokealty Services may not be refundable. These include Third Party Services such as domains, business tools, and applications. The terms of each purchased application or service are set forth on the Brokealty Website. Brokealty or as part of or during the purchase process for such services or applications. It is your obligation to verify the ability to cancel a service before purchasing it. Brokealty will not refund amounts paid for Paid Services, applications, or non-refundable third-party services.
Chargebacks
If at any time we record a decline, chargeback, or other rejection of a charge for Fees payable to your Brokealty account ("Chargeback"), this will be deemed a breach of your payment obligations hereunder, and your use of Brokealty services may be automatically disabled or terminated.
In the event of a Chargeback, your User Account may be blocked without the option to repurchase or reuse it, and the data contained in that User Account, including domains, applications, and Third Party Services, may be subject to cancellation and loss of capacity.
Your use of the Services Brokealty will not resume until you re-subscribe to Brokealty Services and pay any applicable charges in full, including all Fees and expenses incurred by Brokealty or any Third Party Services for each Chargeback received (including Fees for Brokealty Services provided prior to the Chargeback, handling and processing fees, and expenses incurred by the payment processor).
If you have any questions or concerns regarding a payment made to Brokealty, we encourage you to first contact our Customer Service team before filing a Chargeback or payment reversal, to avoid cancellation of Brokealty Services and blocking of your User Account, and to avoid unjustified or erroneous filing of a Chargeback, which may result in you being responsible for applicable Charges, in addition to repayment of all Fees applicable to Brokealty Services purchased (and Charged Back) by you.
We reserve the right to dispute any Chargeback received, including providing the relevant credit card company or financial institution with information and documentation proving that the User responsible for the Chargeback actually authorized the transaction and made use of the services provided thereafter.
Automatic subscription renewals
To ensure that you do not experience any interruption or loss of service, some Paid Services include an automatic renewal option by default, under which, unless you turn off the automatic renewal option, such Paid Services will automatically renew at the end of the applicable subscription period, for a renewal period equal in length to the original subscription period (excluding extended periods) and, unless otherwise notified to you, at the same price (subject to changes in applicable Taxes and excluding any discount or other promotional offer offered for the first period) (“Paid Services Renewal”). For example, if the original subscription period for a Service is one month, each of your renewal periods (as applicable) will be for one month. Accordingly, as applicable, Brokealty will automatically attempt to charge you the applicable Fees using the stored Credit Card within two (2) weeks prior to the beginning of such renewal period. If we are unable to collect the Fees owed by you, we may, at our sole discretion (but are not obligated) reattempt collection at a later time, or suspend or terminate your User Account, without prior notice. If your Paid Services Renewal is subject to an annual or multi-year subscription period, Brokealty will attempt to provide you with notice prior to the renewal of such Paid Service at least thirty (30) days prior to the renewal date.
You can disable the option for automatic renewal of Paid Services at any time in your User Account or by visiting the Brokealty Help Center.
Certain domains are subject to a different renewal policy as detailed in the Domain Registration Agreement. Notwithstanding anything to the contrary in the foregoing, you are and will be solely responsible for verifying and ensuring the successful renewal of the Brokealty Services you use (whether or not the Brokealty Services are subject to automatic subscription renewals). Accordingly, you will be solely responsible for any interruption of the Brokealty Services previously purchased by you, including due to cancellation, failure to charge applicable Recurring Fees, or because some of the Brokealty Services are not subject to automatic subscription renewals. You acknowledge and agree that you will have no claims against Brokealty related to the interruption of any of the Brokealty Services or Third Party Services, for any reason.
